1. Vertragsgegenstand
1.1 Wir, die MaitriBodh Parivaar (International) GmbH, Postfach, 8404 Winterthur, Switzerland,
organisieren Veranstaltungen, führen Seminare und Beratungsleistungen durch und wickeln
Administrationsdienstleistungen ab.
1.2 Durch Ihre Anmeldung besteht ein Vertrag zwischen Ihnen und der MaitriBodh Parivaar
(International) GmbH.
1.3 Die nachfolgenden Bestimmungen gelten für die Teilnahme an allen Kursen.
2. Anmeldung
2.1 Die Anmeldung für Veranstaltungen der MaitriBodh Parivaar (International) GmbH erfolgt
über ein online Buchungssystem. Nach Abschluss der online-Anmeldung inklusive Zahlung des
Kursbeitrages erhalten Sie per E-Mail eine automatische Bestätigung, dass ihre Anmeldung
eingegangen ist. Ihre Anmeldung wird mit Zusendung der Anmeldebestätigung verbindlich.
2.2 Die Anmeldung für Veranstaltungen von MaitriBodh Parivaar (International) GmbH in
Europa bei denen keine Übernachtung inkludiert ist (z.B. BODH-Serie, Retreat, Darshan etc.)
über ein online Buchungssystem. Mit dem Abschluss der Online-Anmeldung schließen Sie einen
Vertrag zur Teilnahme an der Veranstaltung ab. Ein Vertrag über die Teilnahme kommt mit der
Buchung Ihrer Anmeldung zu Stande.
2.3 Die Anmeldung für Veranstaltungen von MaitriBodh Parivaar (International) GmbH in
Europa bei denen Übernachtung inkludiert ist (z.B. BODH, Retreat, Darshan, etc.) erfolgt über
ein online Buchungssystem. Ein Vertrag über die Teilnahme kommt mit der Buchung Ihrer
Anmeldung zu Stande.
2.4 Die Anmeldung für Veranstaltungen in Indien erfolgt ebenfalls über ein online
Buchungssystem. MaitriBodh Parivaar (International) GmbH ist in diesem Fall nicht Veranstalter,
sondern stellt sich als Administrationsabwickler zur Verfügung und handelt nur im Auftrag des
indischen Auftraggebers, mit dem der jeweilige Vertrag zustande kommt. Alle Handlungen, die
MaitriBodh Parivaar (International) GmbH in diesen Fällen ausführt, erfolgen nur im Auftrag für
den indischen Auftraggeber. Nach Abschluss der Online-Anmeldung und Bezahlung der
Teilnahmegebühr erhalten Sie eine automatische E-Mail Bestätigung, dass Ihre Anmeldung
verbindlich gebucht wurde.
3. Zahlungsbedingungen
3.1 Die Zahlung der Teilnahmegebühren ist über ein online Buchungssystem sofort zu bezahlen.
Solange die Teilnahmegebühr nicht vollständig bezahlt ist, ist MaitriBodh Parivaar (International)
GmbH nicht verpflichtet, Ihnen Zugang zur Veranstaltung zu gewähren.
3.2 Nach Vertragsabschluss für Veranstaltungen von MaitriBodh Parivaar (International) GmbH
in Europa oder Veranstaltungen des indischen Auftraggebers in Indien, für die MaitriBodh
Parivaar (International) GmbH nur als Administrationsabwickler fungiert und bei denen
Übernachtung inkludiert ist (z.B. BODH, Retreat, etc.) können Sie die Teilnahmegebühr ebenfalls
über ein online Buchungssystem überweisen. Solange die Teilnahmegebühr nicht vollständig
bezahlt ist, ist MaitriBodh Parivaar (International) GmbH oder der indische Auftraggeber nicht
verpflichtet, Ihnen Zugang zur Veranstaltung zu gewähren.
4. Änderungen der Veranstaltung
4.1 Änderungen im Veranstaltungsprogramm einschließlich einer Umbesetzung bei den
Referenten behalten wir uns vor.
4.2 Bei einer Absage der Veranstaltung aus Gründen, die wir zu vertreten haben, ist keine
Teilnahmegebühr zu zahlen. Bereits gezahlte Teilnahmegebühren werden zurückerstattet.
4.3 Was wir zu vertreten haben, richtet sich nach Ziff. 7 dieser Teilnahmebedingungen.
4.4 Sollte die Veranstaltung aus Gründen, die wir nicht zu vertreten haben, nicht am
vorgesehenen Datum und/oder Ort stattfinden können, behalten wir uns vor, die Veranstaltung auf
ein anderes Datum und/oder Ort unserer Wahl zu verlegen. Sie sind in diesem Fall dann
berechtigt vom Vertrag zurückzutreten, sofern Ihnen die Verlegung im Hinblick auf Datum und/
oder Ort nicht möglich ist.
5. Stornierung
5.1 Für offene Seminare von MaitriBodh Parivaar (International) GmbH gilt eine
Mindestteilnehmerzahl von 6 Personen. Sofern die Mindestteilnehmerzahl nicht erreicht wird,
wird MaitriBodh Parivaar (International) GmbH die Veranstaltung ohne Ersatzanspruch des
Teilnehmers absagen und die Teilnahmegebühr zurückerstatten.
5.2 Eine Stornierung der Anmeldung für Veranstaltungen der MaitriBodh Parivaar (International)
GmbH in Europa (z.B. BODH, Retreat, Darshan, etc.) ist zu folgenden Bedingungen, sofern nicht
anders bei der Ausschreibung spezifiziert, möglich:
Bis 12 Wochen vor Veranstaltungsbeginn kostenfrei
Bis 6 Wochen vor Veranstaltungsbeginn werden 50% der Teilnahmegebühr
zurückerstattet.
Ab 6 Wochen vor Veranstaltungsbeginn ist der gesamte Betrag zu bezahlen.
Die Stornierung oder Benennung eines Ersatzteilnehmers hat schriftlich an MaitriBodh
Parivaar (International) GmbH, Postfach, 8404 Winterthur, Schweiz oder per Mail an
„info@maitribodh.eu“ zu erfolgen.

5.4 Sollte eine Veranstaltung aus Gründen, die der Veranstalter nicht beeinflussen kann (Force
Majeure) nicht stattfinden, behält sich der Veranstalter das Recht vor, die Veranstaltung auf ein
Datum und/oder Ort seiner Wahl zu verlegen.
5.5 Im Falle einer Stornierung durch MaitriBodh Parivaar (International) GmbH haftet
MaitriBodh Parivaar (International) GmbH nicht für die Reiseaufwände, Unterbringungskosten
oder entgangene Verdienstausfälle des Teilnehmers. Die Ersatzansprüche eines Teilnehmers sind
einzig auf die Teilnahmegebühr beschränkt.
6. Zustimmung zur Nutzung von Bildmaterial, der Anfertigung von Bild- und Tonaufnahmen
6.1 Wir werden während der Veranstaltungen Bildmaterial anfertigen oder anfertigen lassen, um
dieses zu Zwecken der Dokumentation, zur begleitenden oder nachträglichen Berichterstattung
und zur Nachbewerbung der Veranstaltung sowie zur gewerblichen Ankündigung darauf
folgender Veranstaltungen nutzen. Dabei kann es sich auch um Bildmaterial handeln, auf dem Sie
abgebildet sind.
Soweit Sie hierbei abgelichtet werden, achten wir darauf, dass Ihre Persönlichkeitsrechte bei der
Nutzung des Bildmaterials nicht unzumutbar beeinträchtigt werden.
6.2 Mit Abschluss des Vertrages über die Teilnahme an der Veranstaltung erteilen Sie uns Ihre
Zustimmung zur Anfertigung und Nutzung des Bildmaterials nach Maßgabe vorstehender Ziffer.
6.3 Zum Schutz der Privatsphäre von Teilnehmern ist die Anfertigung und Nutzung von Ton-,
Bild- und Filmaufnahmen nur mit vorheriger, schriftlicher ausdrücklicher Zustimmung von
MaitriBodh Parivaar (International) GmbH gestattet. Für Informationen zur Genehmigung von
Ton-, Bild- und Filmmaterial kontaktieren Sie uns bitte unter „info@maitribodh.eu“.
7. Haftung
7.1 Wir übernehmen keine Haftung für das Nichtstattfinden der Veranstaltung, sofern wir dies
nicht zu vertreten haben. Wir haften insbesondere nicht für die Versagung erforderlicher
behördlicher Genehmigungen, für polizeiliche und/oder behördliche oder sonstige Auflagen
Dritter während oder im Zusammenhang mit der Veranstaltung, für Rechtsverletzungen von
Teilnehmern und für die Absage oder den Abbruch der Veranstaltung, soweit wir dies nicht
vorsätzlich oder grob fahrlässig zu vertreten haben.
7.2 Wir haften bei einfacher Fahrlässigkeit nur bei Verletzung vertragswesentlicher Pflichten
(Kardinalpflichten), also solcher Pflichten, die die ordnungsgemäße Durchführung des Vertrages
ermöglichen und auf deren Einhaltung der Vertragspartner regelmäßig vertrauen darf. In diesem
Fall ist der Haftungsumfang auf den typischerweise eintretenden, vorhersehbaren Schaden
beschränkt. Es besteht keine Haftung für mittelbare Schäden, Mangel, Folgeschäden oder
entgangenen Gewinn. Die Haftungsbeschränkung gilt auch im Falle des Verschuldens eines
gesetzlichen Vertreters oder Erfüllungsgehilfen von uns.
7.3 Weiters ist unsere vorvertragliche, vertragliche und ausservertragliche Haftung auf Vorsatz
und grobe Fahrlässigkeit beschränkt. Der zu ersetzende Schaden ist jedoch im Falle des grob
fahrlässigen Verschuldens eines einfachen Erfüllungsgehilfen von uns auf den typischerweise
eintretenden, vorhersehbaren Schaden beschränkt.
Die Haftungsbeschränkung für grob fahrlässiges Verschulden des einfachen Erfüllungsgehilfen
gilt indes nicht, wenn der Schaden auf einer Verletzung vertragswesentlicher Pflichten
(Kardinalpflichten) beruht.
7.4 Die Haftungsbeschränkungen gelten nicht im Falle der Verletzung von Leben, Körper oder
Gesundheit eines Menschen und für die Haftung nach dem Produkthaftungsgesetz.
8. Urheberrecht
Mit meiner Unterschrift der Teilnahme an Veranstaltungen von MaitriBodh Parivaar
(International) GmbH akzeptiere ich, dass die geteilten Inhalte und Prozesse im geistigen
Eigentum vom MaitriBodh Parivaar (International) GmbH stehen und dem Urheberrecht
unterliegen.
9. Schlussbestimmungen
9.1 Für sämtliche Ansprüche aus oder im Zusammenhang mit diesem Vertragsverhältnis gilt
Schweizer Recht unter Ausschluss der Bestimmungen der United Nations Convention und
Contracts for the International Sales of Goods (CISG), dem sog. UN-Kaufrecht.
9.2 Das Bezirksgericht Winterthur, Schweiz ist ausschließlicher Gerichtsstand für alle
Streitigkeiten aus oder im Zusammenhang mit uns geschlossener Verträge.
9.3 Sollten eine oder mehrere Bestimmungen dieser Teilnahmebedingungen unwirksam sein oder
werden, wird dadurch die Wirksamkeit der übrigen Bestimmungen nicht berührt.

1. Subject of the contract
1.1 We, MaitriBodh Parivaar (International) Ltd., P.O. Box, 8404 Winterthur, Switzerland,
organize events, conduct seminars and consulting services as well as provide administrative
services.
1.2 Through your registration, a contract exists between you and MaitriBodh Parivaar
(International) Ltd..
1.3 The following provisions apply to the participation in all courses.
2. Registration
2.1 Registration for events of MaitriBodh Parivaar (International) Ltd. is done via an online
booking system. After completing the online registration including payment of the course fee,
you will receive an automatic confirmation by e-mail that your registration has been received.
Your registration becomes binding upon receipt of the registration confirmation.
2.2 Registration for events of MaitriBodh Parivaar (International) Ltd. in Europe which do not
include accommodation (e.g. BODH series, retreat, darshan etc.) is done via an online booking
system. With the completion of the online registration you conclude a contract for participation in
the event. A contract for participation comes into effect with your registration.
2.3 The registration for events of MaitriBodh Parivaar (International) Ltd. in Europe where
accommodation is included (e.g. BODH, Retreat, Darshan, etc.) is done via an online booking
system. A contract for the participation comes into effect with your registration.
2.4 The registration for events in India hosted by MaitriBodh Parivaar Chartiable Turst is also
done via an online booking system. In this case MaitriBodh Parivaar (International) Ltd. is not the
organizer, but acts as an administrative agent and acts only on behalf of the Indian client with
whom the respective contract is concluded. All actions carried out by MaitriBodh Parivaar
(International) Ltd. in these cases are only carried out on behalf of the Indian client, MaitriBodh
Parivaar Chartiable Turst. After completion of the online registration and payment of the
participation fee, you will receive an automatic e-mail confirmation that your registration has
been bindingly booked.
3. Terms of payment
3.1 Payment of the participation fees is to be made immediately via an online booking system. As
long as the participation fee is not paid in full, MaitriBodh Parivaar (International) Ltd. is not
obliged to grant you access to the event.
3.2 After conclusion of the contract for events of MaitriBodh Parivaar (International) Ltd. in
Europe or events of the Indian client MaitriBodh Parivaar Chartiable Turst in India, for which
MaitriBodh Parivaar (International) Ltd. only acts as administrator and where overnight stay is
included (e.g. BODH, retreat, etc.) you can also transfer the participation fee via an online
booking system. As long as the participation fee is not fully paid, MaitriBodh Parivaar
(International) Ltd. or the Indian client MaitriBodh Parivaar Chartiable Turst, is not obliged to
grant you access to the event.
4. Changes to the event
4.1 We reserve the right to make changes to the event programme, including a change in the
composition of the speakers.
4.2 If the event is cancelled for reasons for which we are responsible, no participation fees need
to be payed. Participation fees already paid will be refunded.
4.3 What we are responsible for is determined by section 7 of these terms and conditions of
participation.
4.4 Should the event not be able to take place on the date and/or location planned for reasons for
which we are not responsible, we reserve the right to postpone the event to another date and/or
location of our choice. In this case, you are then entitled to withdraw from the contract if the
rescheduling is not possible for you in terms of date and/or location.
5. Cancellation
5.1 For open seminars of MaitriBodh Parivaar (International) Ltd., a minimum number of 6
participants applies. If the minimum number of participants is not reached, MaitriBodh Parivaar
(International) Ltd. will cancel the event without any claim for compensation on the part of the
participant and refund the participation fee.
5.2 Cancellation of registration for events of MaitriBodh Parivaar (International) Ltd. in Europe
(e.g. BODH, Retreat, Darshan, etc.) is possible under the following conditions, unless otherwise
specified in the announcement:
- Up to 12 weeks before the event free of charge
- Up to 6 weeks before the event, 50% of the participation fee will be refunded.
- From 6 weeks before the event begins, the full amount must be paid.
- The cancellation must be made in written form and send to MaitriBodh Parivaar (International)
Ltd., P.O. Box, 8404 Winterthur, Switzerland or by e-mail to "info@maitribodh.eu".
5.4 Should an event not take place for reasons beyond the Organiser's control (force majeure), the
Organiser reserves the right to postpone the event to a date and/or place of his choice.
5.5 In case of cancellation, MaitriBodh Parivaar (International) Ltd. is not liable for the
participant's travel expenses, accommodation costs or loss of earnings. A participant's claims for
compensation are limited solely to the participation fee.
6. Consent to the use of image material, the production of image and sound recordings
6.1 We will produce or have produced photographic material during the events or have it
produced for the purpose of documentation, accompanying or subsequent reporting and for the
purpose of post-event promotion and commercial announcement of subsequent events. This may
also be image material on which you are depicted.
If you are photographed, we will ensure that your personal rights are not unreasonably affected
when using the image material.
6.2 By concluding the contract for participation in the event, you grant us your consent to the
production and use of the photographic material in accordance with the above clause.
6.3 In order to protect the privacy of participants, the production and use of sound, image and film
recordings is only permitted with the prior written consent of MaitriBodh Parivaar (International)
Ltd.. For information on the approval of sound, image and film footage, please contact us at
"info@maitribodh.eu".
7. Liability
7.1 We do not assume any liability for the event not taking place, unless we are not responsible
for it. In particular, we are not liable for the refusal of necessary official permits, for police and/or
official or other conditions imposed by third parties during or in connection with the event, for
legal violations by participants and for the cancellation or abandonment of the event, unless we
are responsible for this intentionally or through gross negligence.
7.2 In the case of simple negligence, we shall only be liable in the event of a breach of material
contractual obligations (cardinal obligations), i.e. those obligations which enable the proper
execution of the contract and on the observance of which the contractual partner may regularly
rely. In this case the scope of liability is limited to the typically occurring, foreseeable damage.
There is no liability for indirect damages, defects, consequential damages or loss of profit. The
limitation of liability shall also apply in the event of fault on the part of a legal representative or
vicarious agent of ours.
7.3 Furthermore, our pre-contractual, contractual and non-contractual liability is limited to intent
and gross negligence. However, in the event of gross negligence on the part of a simple vicarious
agent of ours, the damage to be compensated is limited to the typically occurring, foreseeable
damage.
However, the limitation of liability for grossly negligent fault of the simple vicarious agent shall
not apply if the damage is based on a breach of essential contractual obligations (cardinal
obligations).
7.4 The limitations of liability shall not apply in the event of injury to life, body or health of a
human being and for liability under the Product Liability Act.
8. Copyright Law
With my signature of participation in events of MaitriBodh Parivaar (International) Ltd. I accept
that the shared contents and processes are the intellectual property of MaitriBodh Parivaar
(International) Ltd. and are subject to copyright.
9. Final provisions
9.1 All claims arising from or in connection with this contractual relationship shall be
governed by Swiss law, excluding the provisions of the United Nations Convention and
Contracts for the International Sales of Goods (CISG), the so-called UN Sales
Convention.
9.2 The District Court of Winterthur, Switzerland shall have exclusive jurisdiction for all
disputes arising from or in connection with contracts concluded with us.
9.3 Should one or more provisions of these terms and conditions of participation be or
become invalid, the validity of the remaining provisions shall not be affected.
